CAN MACHINERY PLACED ON THE MARKET BEFORE 1996 BE CE MARKED?
Let’s start with a short background: The 2006/42/CE Machinery Directive sets a number of regulations and compliances to be met in each production phase, from machinery entry on the market to its end use. Such directive was enforced in Italy on 21 September 1996.
If you own machinery “pre 96” you do not need to provide CE marking but the machinery needs to fulfil the safety requirements set out in annex V of D.Lgs 81/2008.

Once risk assessment and upgrading of machinery have been carried out, you need to draft a declaration of conformity with annex V, in which you state that the machinery is safe and it meets the E.S.R. (ESSENTIAL SAFETY REQUIREMENTS), requested in the above mentioned document.
