IS IT POSSIBLE OR NOT TO MARK MACHINES PLACED ON THE MARKET BEFORE 1996 WITH THE CE MARK?
Let’s start with a brief historical overview: The Machinery Directive 2006/42/EC, which consists of a series of rules and requirements to be met at every stage—from production and placing on the market through to the final use of the machine—officially entered into force in Italy on September 21, 1996.
Therefore, prior to that date, this procedure was not required.
If you own machinery “pre 96” you do not need to provide CE marking but the machinery needs to fulfil the safety requirements set out in annex V of D.Lgs 81/2008.
Are you wondering about practicalities?
Following the risk assessment and the subsequent compliance process, it will be your responsibility to draft a Declaration of Conformity in accordance with Annex V, stating that the machine is safe and complies with the ESS, (ESSENTIAL SAFETY REQUIREMENTS), of the aforementioned annex.
